The House approved a $7.3 billion bill aimed at preventing terrorist attacks on the nation's railways and buses � transit systems that the bill's proponents, including Bucks County Rep. Patrick Murphy, D-8, believe have been overlooked since Sept. 11, 2001.

The legislation, which faces a veto threat from President Bush, was approved Tuesday night by the House by a vote of 299–124 with all opposition coming from Republicans.

The funding is long overdue after terrorists have attacked railroads
and subways in Madrid, London and Mumbai in the past three years, according to Murphy, who called the incidents "a wake-up call for all
of us."

higher education: These were the key points made during
a special roundtable discussion featuring past board
chairs of the Consortium for School Networking (CoSN).

Aimed at celebrating CoSN's 15th anniversary, the event
took place during the nonprofit organization's annual
conference in San Francisco March 28.

Seven former chairs of the group's board of directors,
as well as many other industry leaders, gathered for an
informal conversation centered on the question: Given
the needs of today's learners, as well as the current
context of technology in most school districts, what are
the most important ed-tech leadership issues that are not
receiving attention?

In a spirited, hour-long discussion, participants touched
on a variety of issues--from the need for a formal
certification process for school district chief technology
officers, to the lack of federal leadership on educational
technology under the Bush administration.

But two themes stood out in particular: (1) the need to
shift the focus in the national dialogue about educational
technology from the technology itself to the changes it
enables in teaching and learning, and (2) the need to
overhaul teacher education in the United States to produce
a new generation of educators who are not only comfortable
with technology, but expect it to be used in schools.

'A new vocabulary'

Cheryl Williams, a former CoSN board chair who is now
vice president of marketing for the San Francisco-based
professional development firm Teachscape, said ed-tech
leaders need to "bridge the divide between technology and
teaching." She noted that many conversations about school
technology fail to make the vital connection between the
two--thereby empowering critics who argue that technology
isn't necessary in schools.

"We need a new vocabulary for discussing
[educational technology] with stakeholders," Williams
said.

Princeton/Brookings Future of Children Journal

The Future of Children has released its latest
publication,

Excellence in the Classroom (Vol. 17, No. 1).

The volume focuses on improving the quality of teachers
as a critical move towards closing the achievement gap.
Accompanying the journal is an Executive Summary and a
Policy Brief.

The volume concludes that good teachers make a difference.
According to the fifteen leading scholars who contributed
to the journal, the most promising way to improve teacher
quality is to broaden entry requirements, identify and
promote effective teachers, provide additional pay to
successful teachers who work in challenging schools, and
promote meaningful professional development.

Strengthening the teacher workforce is not a one-time
policy initiative. The editors argue that ongoing
flexibility will be needed for schools to implement these
reforms.

Education policy in individual districts, and in the nation
as a whole, would be well served if reform initiatives were
designed from the outset with credible evaluation elements.

The Future of Children is a co-production of the
Woodrow Wilson School at Princeton University and the

The two judges who oversaw the Anna Nicole Smith cases in
Florida's Broward Circuit Court are swapping jobs -- at
least temporarily. Chief Judge Dale Ross ordered the moves
Tuesday in the wake of complaints and a newspaper editorial

family court until his misdemeanor drug charge is resolved.
Korda, who briefly oversaw the paternity dispute involving
Smith's baby daughter, was cited on March 18 for possession

Police said they caught him smoking pot in a Hollywood,
Fla., park. Circuit Judge Larry Seidlin, who gained national
fame for his courtroom theatrics during the Anna Nicole Smith
body custody case, will move from the probate to the family
division to make way for Korda.

"Texans will not tolerate criminals who exploit senior
citizens," said Attorney General Abbott. "Our Medicaid
Fraud Control Unit will continue cracking down on nursing
homes and their employees who take advantage of their
residents. The elderly must be treated with dignity and
protected from harm. Attorney General Abbott added,
"We are grateful to Ellis County District Attorney
Joe Grubbs for his tremendous assistance with the
prosecution of this case." The Attorney General's
investigation found that Putman, who worked at
Renfro Health Care Center in Waxahachie, diverted
funds belonging to 110 residents into a trust fund bank
account. She then forged 145 checks written on that
account for a total of $356,650, a first-degree felony.
Putman also controlled a single resident's personal
checkbook and wrote checks on that account totaling more
than $34,000, a second-degree felony.

Ellis County Assistant District Attorney Patrick Wilson
and Assistant Attorney General Rodney Boyles will prosecute
the case.In 2005 the Medicaid program in Texas cost more
than $17 billion. As the state's chief law enforcement
official, Attorney General Abbott has dramatically expanded
the Medicaid Fraud Control Unit to save more taxpayer
dollars and increase protection for Texas seniors. The unit,
which handles criminal cases of fraud and abuse, has
established field offices in Corpus Christi, Dallas,
El Paso, Houston, Lubbock, McAllen, San Antonio and Tyler.
It works with federal, state and local agencies across
the state to identify and prosecute those who defraud the
Medicaid program. The Medicaid Fraud Control Unit was
honored in 2004 by the U.S. Department of Health and
Human Services with the Inspector General's State
Fraud Award for effectiveness and efficiency during federal
fiscal year 2003 in combating fraud, patient abuse and neglect
in the Medicaid program.

Sheriff's Raid Can't Pry Client Files From Disbarred Lawyer's Grip
A half-dozen sheriff's deputies raided a disbarred attorney's office last week in New York City in search of the 43 boxes of files he has refused to hand over to the law firm that has taken over his biggest case, a wrongful-death action filed by a Bronx woman on behalf of her husband, a ship-rigger who plummeted to his death at the Brooklyn Navy Yards. For all practical purposes, the deputies came out of Kenneth Heller's office empty-handed.

FDA notified healthcare professionals and patients that Novartis has agreed to discontinue marketing Zelnorm, a drug used for the short-term treatment of women with irritable bowel syndrome with constipation and for patients younger than 65 years of age with chronic constipation. FDA analysis of safety data pooled from 29 clinical trials involving over 18,000 patients showed an excess number of serious cardiovascular adverse events, including angina, heart attacks, and stroke, in patients taking Zelnorm compared to patients given placebo. Patients taking Zelnorm should contact their healthcare professional to discuss treatment alternatives and seek emergency medical care if they experience severe chest pain, shortness of breath, sudden onset of weakness or difficulty walking or talking, or other symptoms of a heart attack or stroke. Healthcare professionals should assess their patients and transition them to other therapies as appropriate.

ROCKVILLE, Md. -- The FDA announced today that Novartis has agreed to withdraw Zelnorm (tegaserod), the only approved drug for irritable bowel syndrome (constipation), after a pooled analysis of 29 placebo-controlled, short-term trials found a small but statistically significant increase in ischemic events, including angina and stroke. The analysis identifed 13 such events, including one death, in more than 11,600 patients treated with tegaserod versus one event among a placebo group.

WASHINGTON Dallas-based law firm Jenkens & Gilchrist will shut its doors and pay a $76 million civil penalty in agreements with federal prosecutors and the IRS over allegedly fraudulent tax shelters that the firm promoted, the government announced Thursday. The Justice Department and the Internal Revenue Service have spent four years examining Jenkens & Gilchrist and its promotion of shelters used to shield billions of dollars from taxes. The government's action against the firm appeared to mark an expansion of its crackdown on questionable tax shelters. In what has been called the largest criminal tax case in U.S. history, major accounting firm KPMG agreed in August 2005 to pay $456 million in a deferred prosecution agreement with the Justice Department in which it admitted to fraudulent conduct in the design and marketing of tax shelters.

Thousands of patients with Alzheimer's disease die prematurely because they are prescribed unlicensed sedative drugs, doctors claim.

The first long-term study shows sufferers die on average six months earlier after being treated with medication designed for schizophrenics.

Campaigners claimed Alzheimer's patients with behavioural problems are being "killed" to make life easier for staff looking after them.

But doctors say there is a lack of alternatives, after a ban imposed last year on anti-dementia drugs costing only 2.50 a day for sufferers with both mild and severe symptoms.

An estimated 100,000 patients with Alzheimer's around 45 per cent of those living in nursing homes are prescribed the drugs even though they are not licensed for the condition.

The five-year study into the sedatives, known as antipsychotics or neuroleptics, was funded by the Alzheimer's Research Trust.

The drugs involved were thioridazine (Mellaril), chlorpromazine (Largactil), haloperidol (Serenace), trifluoperazine (Stelazine) and risperidone (Risperdal).

After three years, only a third of patients prescribed the drugs were alive, compared with two-thirds of those not taking them.

The drugs were also linked with a significant deterioration in verbal fluency and cognitive function.

Researcher Clive Ballard, professor of age-related disorders at King's College London, said: "Even over a six-month period of treatment there is no benefit from these drugs in treating the behaviour in people with Alzheimer's disease when the symptoms are mild.

"These drugs cause the shortening of patients' lives. The system is killing a substantial number of people."

The Food and Drug Administration has identified contaminated wheat gluten from China as the likely cause of poisoned pet food that has sickened a number of dogs and cats, and the agency is investigating to determine whether dry pet foods have also been affected, officials said today.

In a news conference, Stephen F. Sundlof, director of the FDA's Center for Veterinary Medicine, said FDA and independent laboratories have found a chemical called melamine in pet food samples, imported wheat gluten and urine and tissue from diseased pets. He said melamine is used in fertilizer in Asia and in plastic products but is not registered as a fertilizer in the United States.

"Melamine is an ingredient that should not be in pet food at any level," Sundlof said. Nor does it have any approved use in food for humans. He said the FDA is not aware that any of the contaminated wheat gluten went into human food, but said he could not confirm this "with 100 percent certainty."

Sundlof and FDA investigative officials said a company that was found to have imported the contaminated wheat gluten manufactures dry pet food as well as "wet" or "moist" food similar to that previously identified as the source of the illnesses. However, they said, investigators have not yet determined whether any of the wheat gluten has been used in any dry pet food.

The officials declined to name the pet food company or the supplier pending the outcome of the investigation.

"The company that received the gluten that we found to be positive for melamine has been notified," said David Elder, director of the FDA's Office of Enforcement. "We have investigators in the plant today to determine what, if any, finished products were made from that adulterated wheat gluten."

The FDA previously was focusing on "cuts and gravy" pet food manufactured by Ontario-based Menu Foods, which earlier this month recalled more than 60 million cans and pouches sold under 53 dog food brand names and 42 cat brands.

The recall did not apply to dry pet foods.

For years, conservationists have warned about overfishing of large sharks in the northwestern Atlantic, as the demand for meat and fins, coupled with slow growth and reproduction rates of many species, has caused sharp declines in populations of hammerheads, duskies and other sharks.

Researchers are now reporting repercussions beyond the declining shark populations. Depletion of large sharks, they write today in the journal Science, has led to the destruction of the bay scallop fishery along parts of the Eastern seaboard.

The study, by Ransom A. Myers of Dalhousie University in Halifax, Nova Scotia, and colleagues, is among the few to document the cascading effects that the loss of a top predator can have on a marine ecosystem. In the absence of large sharks, the researchers say, the smaller sharks, skates and rays that they feed upon have thrived. In turn, the study shows that as one of these middle links in the food chain, the cownose ray, has become more abundant, it has wiped out scallop beds in North Carolina.

People are always asking me why we should care about sharks, said Ellen Pikitch, a marine biologist at the University of Miami and executive director of the Pew Institute for Ocean Science, a major funder of the study. This is a great example of why sharks matter to the broader ecosystem.

I just got out of an FDA press conference, where a reporter asked the agency's Dr. Stephen Sundlof if people could be feeding unsafe food to their pets right now, because the FDA wont reveal the name of another company – one that makes dry or "kibbled" food as well as "wet" pet food – that received wheat gluten from the same source Menu did.

How about the numbers? asked another attendee. Youre still saying only 15 confirmed deaths, but some reports are in the thousands. How do you explain the discrepancy?

Dr. Sundlof said FDA cant confirm any cases beyond those first few in Menus test labs, even though they have received over 8800 additional reports, because "we have not had the luxury of confirming these reports." Theyll work on that, he said, after they "make sure all the product is off the shelves."

Karen Roebuck of the Pittsburg Tribune-Review, who broke the story earlier this morning that melamine, not aminopterin (a rat poison), had been found in the tested foods, asked if any of the wheat gluten had found its way into the human food supply.

Two McLean High School students have launched a court challenge against a California company hired by their school to catch cheaters, claiming the anti-plagiarism service violates copyright laws.

The lawsuit, filed this week in U.S. District Court in Alexandria, seeks $900,000 in damages from the for-profit service known as Turnitin. The service seeks to root out cheaters by comparing student term papers and essays against a database of more than 22 million student papers as well as online sources and electronic archives of journals. In the process, the student papers are added to the database.

"All of these kids are essentially straight-A students, and they have no interest in plagiarizing," said Robert A. Vanderhye, a McLean attorney representing the students pro bono. "The problem with [Turnitin] is the archiving of the documents. They are violating a right these students have to be in control of their own property."

The legal dispute comes amid a debate over the best way to ensure students are doing their own work at a time when the Internet can make it easy to cheat. Many educators, including Fairfax County school officials, say Turnitin is an effective way to police for plagiarism.

Attorneys for the company and various universities and public school systems, including Fairfax , have concluded that the service doesn't violate student rights.

Ohio University has revoked the master's degree of a former mechanical engineering student whose thesis contained plagiarized material.

This is the first degree revocation to stem from the university's review in spring 2006 of engineering and technology theses and dissertations. OU launched the review after a former student voiced suspicions about plagiarism in documents he was researching.

"Revoking a degree is the very last resort for an institution of higher education," Provost Kathy Krendl said in a news release. "We have put rigorous processes in place, and we are taking the results of those reviews and hearings seriously. We cannot tolerate plagiarism."

When the alleged plagiarism was first brought to light, three committees reviewed 55 documents. The Russ College of Engineering and Technology examined the documents, and then a provost-appointed committee affirmed the results and made recommendations. A third committee of faculty and students from various disciplines acted as a grand jury.

Finally, documents with suspected plagiarism were forwarded to the university's judicial system (for current students) or a hearing committee (for former students). Final adjudication is still underway.

To make sure that any other problems were uncovered, more than 180 additional theses and dissertations were also examined. These included:

* all other theses and dissertations that had been overseen by the two faculty members who advised many of the writers of the original 55 suspect documents;

* several dozen that the current dean and another faculty member volunteered for review;

* additional documents that came into question; and

* an analytical sample of all engineering and technology theses and dissertations dating back to the 1980s.

Finally, I am adding an observation of my own.

Instruction in bibliographic databases is largely absent from the instruction provided at both K-12 and college classroom instruction in the educational settings I have encountered either from teacher or student report. Many if not most students are not taught about bibliographic databases, let alone how to use them at any level of their education experience. At best they may get an hour session regarding these tools from a librarian once or twice in their student career. If one were to suggest spending an hour or two to teach students their entire curriculum exposure in say mathematics or physics, one would laugh the idea off of this planet. So much ink has been spilled in critical exasperation that many students will only use the Wikipedia or Google as the resource finding tools for their reports and research content. Yet the counteraction of providing quality training in the use of databases provided for the public including K-12 students and teachers by many states through public library systems in the United States or by public libraries on their own is ignored by a large number of educators. Instead bibliographic databases are kept a dark secret in many educational environments or simply cited as a resource without instruction in their use.

There is no charge to end users to use these powerful tools. A search of the term WEBBIB0607 will produce in Google Groups, a collection of posts provided this fiscal year that have bibliographies that have been created through the use of databases. The home of Net-Gold on Yahoo Groups will also produce a similar collection of these posts with a search of the "term" WEBBIB0607 in the site search engine for Net-Gold on Yahoo Groups.

The 7th annual Safe Patient Handling and Movement Conference was held March 12–16, 2007, in Lake Buena Vista, Florida. Attendance continues growing and totaled about 1,000 this year, with nearly 700 pre-registered and walk-in attendees and over 300 people associated with about 50 exhibits of the latest technology for safe patient lifting and moving, no lifting programs, etc. Watch www.visn8.med.va.gov/patientsafetycenter for details on this year's conference and mark your calendars for next year, March 10–14, 2008.

My session titled ���The Real-Life Story of a Back-Injured Healthcare Worker: The Costs of Injury are High��� was well-attended. I spoke about my own injury, about why and how lifting patients can cause microfractures to spinal structures which can lead to ���degenerative disc disease,��� and about the widespread practice of terminating back-injured nurses and other healthcare workers who can no longer lift.

The literature mentions that most nurse back injury is from cumulative trauma,��� often without describing damage to specific structures caused by manual patient lifting. Additionally, available data minimizes the severity of healthcare worker injury by specifying sprains and strains as musculoskeletal injury and excluding herniated spinal discs. This would appear to indicate that the primary risk with patient lifting is muscle strain rather than severe spinal damage. We are not losing 12 per cent of our nurse workforce to muscle strain which would be expected to heal in a matter of days or weeks. The severity of spinal injuries caused by lifting people must become more widely known.

Nurses and nursing students must be taught precisely how cumulative microfractures to vertebral endplates and to the nucleus of discs, from repetitively lifting hazardous amounts of weight, can occur over time without pain, until it is too late. Sudden intense pain may announce severely deteriorated spinal discs, identified as degenerative disc disease��� on MRI. After suffering permanent spinal damage, the claims of back-injured nurses are often denied by workers compensation which prefers to focus on single-point-in-time events and often denies degenerative disc disease as pre-existing.

Incidentally, my own workers compensation case required two court appearances, but was ultimately won based on cumulative microtrauma to my spine from years of lifting people. With scientific evidence proving the hazard to the spine from patient lifting, my attorney, Mr. Mike Stebbins, North Bend, Oregon, presented a convincing case. Particularly convincing was the review of research, including nurse injury from patient lifting, in Section E. Disorders of the Low Back in the Ergonomics Program Final Rule, which was rescinded by President Bush. Mr. Stebbins says he will be glad to talk with other attorneys representing injured nurses with similar cases and can be contacted at 541–756–2066.

At any rate, it seems that the practice of unsafe manual patient lifting essentially requires nursing staff to suffer injuries. Workers compensation then frequently denies that the injuries are work-related, and employers frequently terminate injured nurses when they are unable to return to all of the same duties given as essential functions of the job, in this case, lifting.

It was encouraging to meet others from healthcare organizations which retain their injured nurses at the same pay grade, without loss of seniority, in other non-lifting nursing positions. Such organizations should be held forth as role models for many healthcare facilities which routinely discard nurses and other healthcare workers when damaged too badly to be used for further lifting.

While celebrating the passage and introduction of safe patient handling legislation in a number of states, and into the U.S. House of Representatives, it is time to recognize that there are two parts to the problem: 1. Stopping injuries caused by manual patient lifting and 2. Retaining injured nurses and other healthcare workers whose backs, necks, shoulders, etc., have been sacrificed to barbaric unsafe lifting practices.

In addition to outlawing hazardous manual patient lifting, an associated campaign for retention of work-injured nurses must be launched. Ethics aside, it is difficult to understand why, during the most critical nurse shortage ever, there seems to be no large-scale objection to the termination of injured nurses who want to work.

I have heard from many nurses badly damaged by lifting people. Every one is a tale of pain, suffering, and loss, the majority of which could have been prevented by use of appropriate lift equipment. The evening I returned home from the SPHM Conference, I received an email from a nurse which says in part:

���With eight herniated discs, I'm trying to wean myself off of pain meds and try to go back to work. The bank foreclosed and I lost my house after getting hurt and worker's comp insurance company fighting me and refusing to pay. Judge after judge found in my favor and ordered them to pay, but they kept appealing and appealing...and I lost my house. Nice, huh? I'm going stir crazy just sitting watching TV. I can't walk or stand for more than five minutes or so. But there's gotta be some kind of desk job I can do. My brain is fine; it's my back that's not.

This nurse has lost her healthy spine, her nursing career, and her home. The physical devastation from injuries which may have been prevented is bad enough, but, pathetically, there appears to be no system in place to help her and many other injured nurses remain with their employers to avert related career and financial disaster.

Many healthcare facilities still expect work-disabled nurses to just go away. The lucky ones start over at the bottom somewhere else. One nurse disabled by patient lifting was told they didn't care where she went, she could use her critical thinking skills flipping hamburgers, they didn't care, as long as she went back to work. Many enter nursing idealistically believing that nurses and nursing work are highly valued. To be dismissed with such distain after serving so fervently is, to say the least, devastating.

Some said legislation for safe patient handling would never be achieved, yet a wave is occurring across the country which is expected to culminate in passage of a national standard. One thousand people at the 2007 SPHM Conference represent many thousands more working toward implementation of new practices for the safe handling of dependent persons.

It is hoped that a response on a similar scale will occur to assist work-injured nurses, who have sacrificed so much, to remain with the employers where they were injured. Continued silence, and apparent lack of action by many to retain work-injured nurses, seems an implicit endorsement of unchallenged dispose-a-nurse practices, an unsuitable reward for America's most respected profession.

Readings by Computers

The computer-generated voices used in these books are similar to those on automated systems used by the blind, as well as some telephone automation systems.

Most of these titles were generated by Mike Eschman, but a few were made by other people. Over time, the procedures used to generate the audio eBooks changed, so not all audio eBooks have the same sound or pacing by the computer voice.

We have stopped adding computer-generated eBooks. Instead, we are working on methods to automatically make computer-generated eBooks on demand (that is, by choosing options, then getting the file within a short time).

We are aware of numerous anomalies in the computer-generated eBooks, and working to resolve them (slowly!). It turned out that many files were broken and lost: most of Jack London's works are missing, and our Charles Dickens Christmas Carol only has the "small print" license, but no actual eBook. We are regenerating some, removing others, and fixing what we can. If you find something wrong with one of the audio eBooks, chances are it's already on the list to fix, eventually.

The Journal of the Royal College of Surgeons of Edinburgh merged with the Journal of the Irish Colleges of Physicians and Surgeons to launch The Surgeon in February 2003.

The Surgeon is published bimonthly, for the Members & Fellows of each College and the worldwide surgical community. It publishes articles
from all specialties and aims to educate, entertain, give insight into new surgical techniques and technology, and provide a forum for debate and discussion.

In 2005, Disney gave the collection of 525 works to the National Museum of African Art at Smithsonian Institution, where it is now on display. At the Web site, viewers can choose to "Follow the Art" which means visitors can see the works arranged on a time line, from the 1490s to 2007. On this timeline users can examine over two dozen masks, zooming in on details and reading short or long captions and look at figural sculptures and ceremonial objects, including an early 20th century wooden bowl with figures carved by Olowe of Ise, a divination board, and a beaded crown. The show closes with a section called "Explore African Art" that provides a set of activities and further readings for families to do at home. [DS]
